Draft Terms of Service

AthleteOrbit is the working product name of AthleteAlign LLC. These draft terms describe proposed rules for AthleteOrbit, a marketplace where athletes, brands, and agents can discover potential partnerships. They are placeholders pending review by qualified startup, sports, NIL, privacy, and consumer counsel.

1. Eligibility and accounts

Users must provide accurate information, keep their account secure, and use the role that describes them. Athlete accounts for minors require a separately designed guardian-consent process before launch. [ATTORNEY REVIEW: age thresholds, guardian authority, capacity, state NIL rules]

2. Marketplace role

AthleteOrbit offers discovery, compatibility signals, communication, and trust tools. It is not a party to agreements between users and does not act as an agent, attorney, tax adviser, school compliance office, employer, or guarantor. Users must independently evaluate opportunities and applicable school, conference, NCAA, league, union, licensing, agent-registration, disclosure, and state-law requirements.

3. Matching and verification

Match scores and AI-assisted signals are informational estimates, may be incomplete, and do not guarantee suitability, eligibility, performance, authenticity, or outcomes. A verification badge states only the checks completed and may expire or be suspended. Serious trust decisions require human review; AI signals alone cannot make irreversible reputation decisions.

4. Acceptable use

Users may not impersonate others; submit deceptive campaigns; harass, discriminate, exploit minors, scrape profiles, bypass blocks, distribute malware, expose private data, manipulate engagement, or use the service for unlawful activity. Reports must be made in good faith.

5. User content and evidence

Users retain their content and would grant AthleteOrbit only the rights needed to host, display, secure, moderate, and operate it. Evidence submitted in disputes must be lawful to share. [ATTORNEY REVIEW: license, publicity rights, DMCA process, testimonial/endorsement rules]

6. Reports, disputes, and appeals

AthleteOrbit may investigate reports, request a response, restrict features while necessary for safety, make a documented human decision, notify affected users, and accept an appeal. Emergency measures and the standard of review require final policy and counsel approval.

7. Suspension and termination

Access may be limited for security, safety, legal, or policy reasons. Except when unsafe or prohibited, users should receive notice and an appeal opportunity. Account deletion is subject to the draft retention approach in the Privacy Policy.

8. Disclaimers and liability

[ATTORNEY TO DRAFT: warranties, limitation of liability, indemnity, governing law, venue/arbitration, class-action waiver if appropriate, notice, severability, changes, contact and entity identity.]

9. Contact
